Who Gets Double Time Pay

dollarsThe FLSA has laws regulating overtime pay but not double time pay. They do stipulate that employers are not barred from offering double time pay, but that it is not a requirement on a federal level.

Double time pay, however, is required in certain instances in the state of California.

For non-exempt employees, California workers must receive double time pay for any hours worked over 12 in a day and any hours worked over 8 on the 7th day. For exempt employees, however, i.e. those who do not receive overtime, the double time rules do not apply.
